Terms & Conditions for Retail Equipment Purchase, Optional Independent Installation, Warranty, and Payment

Seller/Retail Provider: Pool Supplies of Corona Corp.
These Terms & Conditions apply to retail purchases of pool equipment, pool parts, heaters, pumps, filters, automation systems, salt systems, replacement components, and related materials sold by Pool Supplies of Corona Corp.
Pool Supplies of Corona Corp. acts as the retail seller and distributor of equipment and materials. Installation services are not included unless separately selected by customer and expressly listed in writing.
If installation services are separately selected, those services are performed exclusively by PSOFC Corp., CSLB License #1080105, an independent California licensed contractor operating separately from Pool Supplies of Corona Corp., referred to in these Terms as the Installation Provider.
Pool Supplies of Corona Corp. does not supervise, direct, control, manage, warrant, or assume responsibility for contractor means, methods, workmanship, labor practices, licensing compliance, permitting, safety compliance, field operations, scheduling, or contractor services performed by the Installation Provider.
Nothing in these Terms creates a partnership, joint venture, employment relationship, agency relationship, franchise relationship, or shared contractor liability between Pool Supplies of Corona Corp. and the Installation Provider.
1. Acceptance of Terms
A. By submitting an order, approving an estimate, paying an invoice, completing a checkout form, checking an acknowledgment box, clicking “I Agree,” proceeding to Stripe payment, authorizing equipment ordering, accepting delivery, or allowing any separately selected installation or service work to proceed, customer acknowledges that customer has reviewed, understood, and agreed to these Terms & Conditions.
B. Customer understands that checkout acknowledgments, invoice notes, payment page notices, form disclosures, or summary notices are intended to summarize key terms only and do not replace the full Terms & Conditions.
C. By proceeding to payment, customer confirms review and acceptance of the applicable Terms & Conditions, Privacy Policy, manufacturer warranty information, invoice, estimate, checkout page, written scope, payment page, and related transaction documents.
D. These Terms apply together with any invoice, estimate, checkout page, work order, written scope, manufacturer terms, warranty documentation, payment processor terms, and transaction records related to the purchase.
E. If customer does not agree to these Terms, customer must not proceed with payment, authorize ordering, accept delivery, or allow any separately selected installation or service work to begin.
2. Retail Seller Status and Independent Contractor Separation
A. Pool Supplies of Corona Corp. acts solely as the retail seller and distributor of pool equipment, pool parts, materials, replacement components, and related products.
B. If installation services are separately selected by customer, those services are performed exclusively by PSOFC Corp., CSLB License #1080105, an independent California licensed contractor operating separately from Pool Supplies of Corona Corp. PSOFC Corp. is referred to in these Terms as the Installation Provider.
C. Pool Supplies of Corona Corp. does not supervise, direct, control, manage, warrant, or assume responsibility for contractor means, methods, workmanship, labor practices, licensing compliance, permitting, safety compliance, field operations, scheduling, or field decisions performed by the Installation Provider.
D. Nothing in these Terms creates a partnership, joint venture, employment relationship, agency relationship, franchise relationship, or shared contractor liability between Pool Supplies of Corona Corp. and the Installation Provider.
E. Any contractor-related claim, workmanship concern, labor correction request, field condition issue, permit issue, code issue, scheduling issue, or installation-service dispute must be directed to the Installation Provider performing the work, except where applicable law requires otherwise.
3. Purchase Type Selection
A. Customer may be asked to select one of the following purchase types before checkout or payment.
B. Equipment Purchase Only: Customer is purchasing equipment, parts, or materials only. Installation is not included unless separately listed in writing on the invoice, estimate, checkout page, work order, or approved written scope.
C. For equipment purchase only transactions, Pool Supplies of Corona Corp. is not responsible for installation, site compatibility, customer installation errors, third-party installation errors, startup issues caused by installation, manufacturer warranty consequences related to installation method, or any conditions arising from the manner in which the product is installed, connected, started, maintained, or used.
D. Equipment Plus Optional Installation: Customer is purchasing equipment from Pool Supplies of Corona Corp. and separately electing installation services from the Installation Provider only when installation is expressly listed in writing.
E. Customer understands that optional installation services are separate from the retail equipment sale and are subject to site conditions, applicable California contractor licensing laws, CSLB regulations, safety requirements, manufacturer instructions, written scope limitations, and the Installation Provider’s contractor obligations.
F. Selecting optional installation does not guarantee manufacturer warranty approval, coverage, replacement, repair, claim acceptance, or labor reimbursement. Manufacturer warranty requirements are determined solely by the manufacturer and may vary depending on product, installation method, documentation requirements, and manufacturer policies.
4. Final Sale, Special Orders, and Cancellations
A. All equipment sales are final upon payment, except where prohibited by applicable law.
B. Customer understands that pool equipment, replacement parts, heaters, pumps, filters, automation systems, salt systems, electrical components, gas-related components, water-contact components, and related materials may be ordered, reserved, allocated, transferred, shipped, direct-shipped, specially procured, or otherwise committed based on customer approval and payment.
C. Heaters, non-stock items, direct-ship products, special-order products, custom-order products, manufacturer-controlled products, and specially procured equipment are non-cancelable once paid, ordered, reserved, released for fulfillment, transferred, shipped, direct-shipped, or otherwise committed to customer transaction.
D. Cancellation requests are not guaranteed after payment or after an item has been ordered, reserved, allocated, released for fulfillment, transferred, shipped, direct-shipped, or specially procured.
E. Returns, refunds, exchanges, or cancellations are not guaranteed and may be unavailable for special-order, custom-order, installed, opened, used, electrical, gas, water-contact, manufacturer-controlled, direct-ship, or non-stock products.
F. Approved returns, if any, may be subject to manufacturer, supplier, freight, inspection, handling, processing, merchant processing, and restocking charges. Shipping, freight, handling, merchant processing, special-order, and installation-related costs may be non-refundable where permitted by law.
G. Nothing in this section limits rights that cannot be waived under applicable law.
5. Product Information, Compatibility, and Customer Product Selection
A. Product descriptions, photos, specifications, model numbers, compatibility information, availability, and website summaries are provided for general reference and may be based on manufacturer information.
B. Customer is responsible for confirming that selected products are suitable for the intended pool, spa, plumbing, electrical, gas, automation, environmental, equipment pad, and installation conditions unless customer separately retains a qualified professional to evaluate those conditions.
C. Manufacturer specifications, installation manuals, product labels, applicable codes, and written manufacturer requirements control over general descriptions, website summaries, informal communications, or product images.
D. Pool Supplies of Corona Corp. is not responsible for customer-selected products that are incompatible due to existing site conditions, incorrect assumptions, prior modifications, unknown equipment history, electrical limitations, plumbing restrictions, gas supply issues, automation incompatibility, code issues, access limitations, manufacturer requirements, or third-party representations.
E. Pool Supplies of Corona Corp. does not warrant that a product selected by customer will be compatible with customer property, existing equipment, automation system, gas supply, electrical system, plumbing configuration, local code requirements, or manufacturer installation requirements unless such representation is expressly made in writing by Pool Supplies of Corona Corp.
6. Payment, Taxes, Pricing, and Scope Charges
A. Customer agrees to pay all listed product charges, applicable taxes, approved materials, delivery charges, freight charges, service charges, installation charges when separately selected, and any other charges shown on the invoice, estimate, checkout page, payment link, or approved written scope.
B. Equipment and applicable taxes may be due before ordering, scheduling, release of equipment, delivery, pickup, transfer, or fulfillment.
C. Any optional installation labor, approved materials, startup, or related service charges may be billed separately by the Installation Provider or as otherwise listed on the written invoice, estimate, checkout page, or approved scope.
D. Prices are subject to correction for clerical errors, supplier changes, manufacturer pricing changes, freight changes, tax changes, product availability changes, or approved scope changes before payment is completed and the order is accepted.
E. Where equipment and installation labor are listed separately, taxes may apply to equipment and materials and may be treated differently from separately stated labor depending on transaction structure and applicable law.
F. Customer is responsible for any additional approved charges arising from customer-requested changes, product substitutions, scope changes, delivery changes, access issues, hidden conditions, site limitations, manufacturer-required corrections, or services outside the written scope.
7. Optional Installation Services
A. Equipment purchases do not include installation unless installation is separately listed in writing.
B. If customer separately elects installation services, those services are performed exclusively by PSOFC Corp., CSLB License #1080105, an independently licensed California contractor.
C. Pool Supplies of Corona Corp. acts solely as the retail seller of equipment and materials and is not responsible for contractor operations, field labor, installation methods, permitting, code compliance, workmanship, delays, scheduling, site safety, hidden site conditions, field decisions, or contractor-related claims.
D. Customer understands that contractor services are separate from the retail equipment transaction.
E. Installation is included only if expressly listed on the invoice, estimate, checkout page, work order, or approved written scope. If installation is not listed, customer is purchasing equipment only.
F. When installation services are selected and approved, customer authorizes the Installation Provider, not Pool Supplies of Corona Corp., to perform the listed installation, startup, and testing under existing site conditions and within the approved written scope.
8. Installation Scope Limitations
A. Optional installation services include only the labor, materials, and services expressly described in the invoice, estimate, checkout page, work order, or approved written scope.
B. Unless expressly stated in writing, installation does not include correction of pre-existing code violations, electrical upgrades, gas line resizing, gas repairs, gas utility work, plumbing corrections outside the listed scope, automation rewiring, automation programming beyond the listed scope, structural repairs, equipment pad replacement or correction, access modifications, trenching, concrete work, decking work, wall repairs, landscape repairs, replacement of unrelated equipment, permit fees, permit processing, utility upgrades, correction of hidden conditions, repair of third-party work, correction of prior improper installation, or replacement of incompatible existing systems.
C. Work outside the approved written scope requires separate approval and may result in additional charges.
D. Pool Supplies of Corona Corp. is not responsible for determining, performing, supervising, approving, or warranting installation work outside the retail sale of equipment unless expressly stated in a separate written agreement signed by Pool Supplies of Corona Corp.
9. Hidden, Unsafe, or Unforeseen Conditions
A. Customer understands that hidden, concealed, unsafe, inaccessible, non-code compliant, incompatible, or unforeseen conditions may be discovered before, during, or after installation, service, startup, or testing.
B. Examples may include plumbing defects, electrical deficiencies, undersized or damaged wiring, failed conduit, gas supply issues, gas line sizing problems, leaks, corrosion, concealed damage, code violations, inaccessible equipment, unsafe equipment pads, undocumented prior modifications, incompatible existing systems, automation incompatibility, structural issues, water chemistry damage, freeze damage, utility problems, manufacturer-required corrections, permit requirements, or conditions requiring change orders.
C. If such conditions are discovered, the Installation Provider may pause, suspend, reschedule, or decline work if conditions are unsafe, inaccessible, non-code compliant, incompatible with proposed equipment, outside the approved written scope, or otherwise unsuitable for safe completion.
D. If such conditions prevent completion of the listed scope, theInstallation Provider may notify customer and provide a reasonable opportunity to approve corrective work, revised scope, rescheduling, additional labor, additional materials, permit-related requirements, or additional charges before proceeding.
E. Delays, suspension, inability to proceed, or additional charges caused by hidden, unsafe, pre-existing, or unforeseen conditions are not a breach by Pool Supplies of Corona Corp. or, where applicable, the Installation Provider.
F. Customer understands that additional approved charges may be billed separately.
10. Customer Responsibilities
A. Customer is responsible for providing accurate order information, contact information, site information, equipment information, access instructions, and known site-condition concerns.
B. Customer responsibilities include confirming product selection when purchasing equipment only; providing safe and reasonable access to the service area when optional installation is selected; addressing gates, pets, locks, alarms, and access restrictions; maintaining proper water chemistry; maintaining pool and spa equipment according to manufacturer requirements; registering products where required by manufacturer; retaining proof of purchase and proof of installation; and preserving invoices, receipts, serial numbers, product packaging where relevant, warranty documents, photos, communications, and transaction records.
C. Customer is responsible for protecting equipment from freeze damage, water chemistry damage, chemical imbalance, power surges, misuse, neglect, unauthorized modifications, and operation outside manufacturer instructions.
D. Customer must promptly report product issues, visible damage, missing items, malfunction, unsafe conditions, installation concerns, or warranty concerns.
E. Customer is responsible for obtaining HOA, landlord, property owner, property manager, or other approvals where applicable.
F. Customer understands that failure to maintain proper water chemistry, access, maintenance, registration, freeze protection, documentation, or timely reporting may affect product performance, manufacturer warranty eligibility, service availability, claim outcomes, carrier claims, supplier claims, replacement eligibility, or dispute resolution.
11. Independent Contractor Warranty Responsibility
A. If installation services are separately selected by customer, any labor warranty, workmanship representation, installation correction obligation, or contractor-related service responsibility is solely the responsibility of the independently licensed Installation Provider performing the work.
B. Pool Supplies of Corona Corp. does not provide installation warranties, workmanship guarantees, contractor supervision, field quality-control services, or labor-performance guarantees unless expressly stated in a separate written agreement signed by Pool Supplies of Corona Corp.
C. Any manufacturer product warranty remains subject solely to the manufacturer’s written warranty terms.
D. No statement regarding contractor workmanship, contractor correction, contractor labor, or field performance shall be interpreted as a warranty, guarantee, or assumption of contractor responsibility by Pool Supplies of Corona Corp.
12. Manufacturer Warranty
A. Manufacturer warranty eligibility, coverage periods, registration requirements, proof of purchase requirements, installation requirements, labor reimbursement policies, and claim procedures are determined solely by the manufacturer’s current written warranty terms. Customer is responsible for reviewing applicable manufacturer warranty documentation before purchase and/or installation.
B. Pool Supplies of Corona Corp. does not independently warrant manufacturer products unless expressly stated in writing.
C. All manufacturer warranty determinations, approvals, denials, coverage decisions, reimbursement decisions, replacement decisions, repair decisions, processing timelines, and claim administration remain solely under manufacturer control.
D. Pool Supplies of Corona Corp. and the Installation Provider do not control manufacturer warranty approvals, denials, claim administration, labor reimbursement decisions, product-specific warranty eligibility, or changes to manufacturer warranty programs.
E. Manufacturer warranty eligibility may require qualifying professional installation, product registration, proof of purchase, proof of professional installation, installation documentation, and compliance with manufacturer requirements.
F. Manufacturer warranty programs, coverage periods, product eligibility rules, registration requirements, labor reimbursement policies, and claim procedures may change without notice. Pool Supplies of Corona Corp. and the Installation Provider do not guarantee manufacturer warranty approval, coverage, replacement, repair, labor reimbursement, claim processing time, or final claim outcome.
G. Some manufacturer warranties may differ depending on where the product was purchased; whether the product was purchased online, over-the-counter, through retail, or through an authorized channel; whether the product was professionally installed; whether installation documentation is available; whether the product is registered; whether proof of purchase is provided; whether proof of professional installation is provided; and whether manufacturer-specific requirements are satisfied.
H. For applicable products, equipment purchased without qualifying professional installation may receive reduced manufacturer warranty coverage, including possible limited warranty periods, depending on the manufacturer’s current written warranty terms.
I. Installation by the Installation Provider does not guarantee manufacturer warranty approval. Manufacturer warranty requirements are determined solely by the manufacturer and may vary depending on product, installation method, documentation requirements, and manufacturer policies.
J. Manufacturer warranty claims are administered by the manufacturer, not by Pool Supplies of Corona Corp. or the Installation Provider.
K. Any assistance provided by Pool Supplies of Corona Corp. regarding manufacturer documentation, proof of purchase, product information, installation records, or service information is courtesy support only and does not create independent warranty obligations or guarantee claim approval.

14. Shipping, Delivery, Damage, and Delays
A. Products may be picked up, delivered, transferred to the Installation Provider when optional installation is selected, shipped by manufacturer, shipped by supplier, direct-shipped, or otherwise fulfilled depending on product and transaction.
B. Customer authorizes Pool Supplies of Corona Corp. to release or transfer purchased equipment to the Installation Provider only when customer has separately selected installation.
C. Shipping, delivery, freight, manufacturer processing, warehouse fulfillment, supplier availability, backorders, direct-ship timelines, transfer timelines, and weather-related timelines are estimates only and are not guaranteed unless expressly stated in writing.
D. Customer must inspect delivered or received products promptly.
E. Visible shipping damage, missing items, packaging damage, or delivery discrepancies must be reported within 48 hours of delivery or receipt.
F. Failure to report visible damage, missing items, or packaging damage within 48 hours may affect carrier claims, supplier claims, manufacturer claims, replacement eligibility, refund eligibility, or the ability to document shipping-related issues.
G. Customer should retain packaging, photos, labels, tracking information, freight documents, and delivery documentation related to any damaged shipment.
15. Communication Consent
A. Customer consents to receive transaction-related communications by phone, email, text message, or other contact methods provided by customer.
B. Transactional communications may include order updates, checkout confirmations, payment reminders, receipt delivery, scheduling updates, delivery or pickup updates, installation coordination when optional installation is selected, warranty documentation, product support, service follow-up, dispute resolution, account communications, and compliance communications.
C. Customer understands that standard carrier messaging and data rates may apply for SMS communications.
D. This consent applies to transactional communications related to customer’s order, payment, delivery, optional installation, service, warranty support, or dispute documentation and does not require customer to consent to unrelated marketing communications unless separately requested.
16. Privacy and Customer Information
A. Customer information may be collected and used for order processing, payment processing, scheduling, delivery or pickup coordination, optional installation coordination, warranty documentation, product registration support, customer service, technical support, dispute prevention, fraud prevention, legal or regulatory compliance, transaction records, manufacturer support, and supplier support.
B. Customer information may be shared with payment processors, manufacturers, suppliers, the Installation Provider when optional installation is selected, freight providers, service providers, warranty administrators, legal or compliance providers, or other parties reasonably necessary to complete the transaction, provide support, document the transaction, or comply with applicable obligations.
C. Pool Supplies of Corona Corp. does not authorize use of private customer-identifying information for unrelated public marketing unless separately approved by customer.
17. Media, Photos, and Documentation
A. If installation, service, inspection, warranty support, damage documentation, delivery documentation, or dispute documentation is involved, customer authorizes Pool Supplies of Corona Corp. and/or the Installation Provider, as applicable, to take, retain, and use photos, videos, notes, serial numbers, labels, product information, and other documentation of equipment, installation conditions, site conditions, plumbing, electrical connections, gas lines, automation systems, defects, damage, access conditions, packaging, delivery condition, or completed work.
B. Such documentation may be used for warranty claims, manufacturer support, supplier support, quality assurance, internal records, service history, proof of installation, proof of condition, proof of damage, dispute resolution, chargeback response, and compliance records.
C. This authorization does not grant permission to use private customer-identifying information for unrelated public marketing unless separately approved.
18. Disputes, Chargebacks, and Resolution
A. Customer agrees to contact Pool Supplies of Corona Corp. and/or the Installation Provider, as applicable, regarding any issue with an order, payment, product, optional installation, service, warranty question, delivery, invoice, or checkout before initiating an external dispute, chargeback, complaint, or payment reversal, where permitted by law.
B. Where permitted by law, customer agrees to provide Pool Supplies of Corona Corp. and/or the Installation Provider, as applicable, a reasonable opportunity, not less than fifteen (15) days where practical, to review and attempt to resolve the issue before initiating an external dispute, chargeback, complaint, or payment reversal.
C. This does not waive rights customer may have under applicable law, card network rules, payment processor rules, or consumer protection laws, but gives the applicable party an opportunity to review and resolve the issue directly.
D. Customer understands that electronic records, invoice records, checkout records, payment records, shipping records, communication records, photos, product documentation, delivery records, installation records when applicable, signed forms, form submissions, SMS records, emails, acceptance logs, IP/session metadata, payment confirmations, and related communications may be used to respond to disputes, chargebacks, claims, complaints, or payment reversals.
19. Limitation of Liability
A. To the fullest extent permitted by applicable law, Pool Supplies of Corona Corp. shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of use, loss of enjoyment, water loss, utility costs, chemical costs, lost profits, delay damages, property-related inconvenience, or damages caused by pre-existing conditions, hidden conditions, third-party work, manufacturer defects, supplier delays, freight delays, customer-selected products, improper maintenance, water chemistry issues, freeze events, utility problems, or conditions outside the approved written scope.
B. To the fullest extent permitted by law, Pool Supplies of Corona Corp. shall not be liable for acts, omissions, delays, workmanship issues, code violations, contractor negligence, scheduling issues, field conditions, permitting issues, safety issues, or labor-performance issues associated with independently performed installation services.
C. Claims related to installation labor or contractor operations must be directed to the Installation Provider performing the work, except where applicable law requires otherwise.
D. To the fullest extent permitted by applicable law, any liability of Pool Supplies of Corona Corp. shall be limited to the amount paid by customer to Pool Supplies of Corona Corp. for the specific product giving rise to the claim.
E. To the fullest extent permitted by applicable law, any liability of the Installation Provider shall be limited to the amount paid by customer for the specific installation or service giving rise to the claim.
F. Nothing in this section limits liability where such limitation is prohibited by applicable law.
20. Electronic Acceptance and Records
A. Customer agrees that electronic acceptance has the same effect as written acceptance.
B. Electronic acceptance may include checking required acknowledgment boxes, submitting a Wix form, clicking “I Agree,” proceeding to Stripe payment, paying an invoice, approving an estimate, authorizing equipment ordering, authorizing release of equipment, communicating approval by email, communicating approval by text message, accepting delivery, allowing optional installation or service work to proceed, signing electronic or paper forms, or receiving checkout confirmations.
C. Customer understands that acceptance, authorization, and transaction records may include timestamps, IP address, session metadata, device or browser information where available, Wix form submissions, Stripe payment records, checkout records, invoice records, payment confirmations, email records, SMS records, signed forms, customer communications, and related transaction records.
D. Customer agrees that such records may be retained and used as evidence of acceptance, authorization, payment, communication, delivery, installation when applicable, warranty support, dispute response, chargeback response, and transaction history.
21. No Oral Modification
A. No oral statement, text message, informal communication, product discussion, scheduling discussion, website summary, invoice note, or customer-service communication modifies these Terms unless the modification is expressly confirmed in a written agreement signed or formally approved by Pool Supplies of Corona Corp.
B. Customer understands that manufacturer documents, written invoices, written estimates, checkout records, payment records, and approved written scopes control over informal communications or assumptions.
22. Governing Law and Venue
A. These Terms are governed by California law unless otherwise required by applicable law.
B. Any dispute shall be handled in California and in the appropriate venue permitted by law, unless a different venue is required by applicable consumer protection law, contractor law, payment processor rule, card network rule, or other controlling law.
C. Nothing in this section limits rights, venue protections, statutory remedies, or dispute rights that cannot be waived under applicable law.
